Welcome to Digit Soil. These Terms and Conditions ("Terms") govern your access to and use of our website and webshop, located at www.digit-soil.com, and any related services provided by us.

By accessing or using our website or placing an order through our webshop, you agree to be bound by these Terms. If you do not agree with any part of the Terms, please refrain from using our services.

2. Scope of Application

These Terms apply to all contracts concluded between us and you as a customer through our webshop. The version valid at the time the contract is concluded shall apply.​

3. Use of the Webshop

You agree to use our website and webshop only for lawful purposes. You must be at least 18 years old to place an order, or have permission from a legal guardian.

4. Orders and Contract Conclusion

All offers displayed on our webshop are non-binding. A purchase contract is only concluded when we confirm your order via email or dispatch the goods.

We reserve the right to refuse or cancel any order in cases of pricing errors, insufficient stock, or suspicion of fraud.

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

5. Prices and Payment

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page. All prices are listed in Swiss Francs (CHF) and include the applicable value-added tax (VAT). Shipping costs, if any, will be clearly indicated before finalizing the purchase.

Accepted payment methods include:

Payment must be made in full before the goods are dispatched.

6. Shipping and Delivery

We deliver within Switzerland and to selected international locations. Delivery times vary by product and destination and are specified during checkout.

We are not liable for delays due to third-party carriers or customs processing in international shipping.

7. Right of Withdrawal / Return and Refund Policy

Swiss law does not generally require companies to accept returns unless the product is defective or otherwise agreed. However, we voluntarily offer a 14-day return policy from the date of receipt for any undamaged product and we will exchange it or offer a refund based upon the original payment method.

Returned items must be unused and in original packaging. Return shipping costs are borne by the customer unless the return is due to an error on our part. In addition, please note the following: (i) Products can be returned only in the country in which they were originally purchased; and (ii) the following products are not eligible for return: Consumables.

8. Warranty and Liability

We offer warranty according to Swiss statutory provisions. For any defective or damaged products, please contact us within 7 days of receiving the item. When we receive a valid warranty claim for a product purchased from us, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, the customer will be entitled to a full refund upon the prompt return of the product to us. We will pay for shipment of repaired or replaced products to customers and customers will be responsible for returning shipment of the product to us.

We are not liable for indirect or consequential damages, except in cases of gross negligence or intent.

9. Data Protection

Your personal data is handled with care and in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the General Data Protection Regulation (GDPR). For details, please refer to our Privacy Policy.

10. Intellectual Property

The service and all content on our website, including, without limitation, software, images, logos, audio and videos, text, and design are the exclusive property of Digit Soil and is protected by copyright and intellectual property laws. You may not use or reproduce any part of the website without our prior written consent. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

11. Applicable Law and Jurisdiction

These Terms are governed by the laws of Switzerland. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts at our registered place of business.

12: Indemnification & limitation of liability

You agree to indemnify and hold Digit Soil harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

To the maximum extent permitted by applicable law, in no event shall Digit Soil be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Digit Soil assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

We reserve the right to update or modify these Terms at any time. Changes will be published on this page with the updated effective date.
